OVERVIEW
Welcome to KidsStrike. The terms "we", "us" and "our" refer to KidsStrike. KidsStrike operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). KidsStrike is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully — they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy at /policies/privacy-policy. If you do not agree, you should not use or access our Services.
Nothing in these Terms affects your statutory rights as a consumer.
SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least the age of majority where you live, and that you consent to any minor dependants using the Services on devices you own or manage.
To use the Services you may be asked to provide information such as your email address and billing, payment and delivery details. You confirm that the information you provide is correct, current and complete.
You are responsible for keeping your account credentials secure and for activity on your account. You may not transfer, sell or assign your account to anyone else.
SECTION 2 — OUR PRODUCTS
We make every effort to represent our products accurately. Colours and appearance may differ slightly from how they look on your screen depending on your device and its settings.
Age recommendations shown on product pages are guidance. Please read the age guidance and any safety information on the product page and on the packaging, and supervise children as appropriate. Some products contain small parts or magnets and are not suitable for children under 3.
Product descriptions may change at any time. We may discontinue a product or limit quantities at our discretion.
SECTION 3 — ORDERS
When you place an order you are making an offer to buy. A contract is formed when we confirm that your order has been dispatched. We may decline or cancel an order — for example if an item is out of stock, if there was a pricing or description error, or if we suspect fraud. If we cancel, we refund you in full.
Your purchases are subject to return or exchange in accordance with our Refund Policy at /policies/refund-policy, and to your statutory rights.
You confirm that your purchases are for your own personal or household use and not for commercial resale.
SECTION 4 — PRICES AND BILLING
All prices are shown in pounds sterling and include UK VAT where applicable. Delivery is charged separately and shown before you pay.
Prices and promotions may change without notice. The price that applies is the one in effect when you place your order, as set out in your order confirmation.
We take care to price accurately. If we find an error in the price of something you have ordered, we will contact you before dispatch and offer you the choice of continuing at the correct price or cancelling for a full refund.
You agree to provide accurate payment and account information, and to keep it up to date.
SECTION 5 — DELIVERY
Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs processing or events outside our reasonable control. Our delivery obligations, including the statutory 30-day limit, are set out in our Shipping Policy at /policies/shipping-policy.
SECTION 6 — INTELLECTUAL PROPERTY
Our Services, including all trade marks, brands, text, images, graphics, video and audio, and the design, selection and arrangement of them, are owned by KidsStrike, its affiliates or licensors, and are protected by UK and international intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, republish or transmit any material from the Services without our prior written consent.
KidsStrike's name, logo and product names are trade marks of KidsStrike. Shopify's name and logo are trade marks of Shopify. All other names and logos belong to their respective owners.
SECTION 7 — OPTIONAL TOOLS
We may give you access to third-party tools that we neither monitor nor control. These are provided "as is" without warranties of any kind and without endorsement. Any use of them is at your own risk, and you should make sure you are familiar with the third party's own terms.
SECTION 8 — THIRD-PARTY LINKS
The Services may link to websites operated by third parties. We are not responsible for their content or accuracy. If you leave our Services to visit them, you do so at your own risk, and any complaints about third-party products or services should be directed to that third party.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
KidsStrike is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with KidsStrike. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and KidsStrike, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with KidsStrike.
SECTION 10 — PRIVACY
All personal information we collect through the Services is subject to our Privacy Policy at /policies/privacy-policy, and certain personal information may be subject to Shopify's Privacy Policy at https://www.shopify.com/legal/privacy/app-users.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify and third parties located in other countries.
SECTION 11 — FEEDBACK AND REVIEWS
If you send us ideas, suggestions, feedback or reviews, you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and display that content for any purpose, including commercially.
You confirm that any content you submit is your own, does not infringe anyone else's rights, and is not unlawful, abusive or obscene. You must not use a false email address or pretend to be someone else. We may, but are not obliged to, monitor, edit or remove submitted content.
SECTION 12 — ERRORS AND OMISSIONS
Occasionally information in the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, delivery charges, transit times or availability. We reserve the right to correct these and to change or update information, or cancel orders, if any information is inaccurate — including after you have submitted an order.
SECTION 13 — PROHIBITED USES
You may use the Services for lawful purposes only. You must not use them for any unlawful or malicious purpose, to violate any applicable laws or regulations, to infringe intellectual property rights, to harass or harm any person, to transmit false or misleading information, to send spam, to impersonate anyone, or in any way that restricts anyone else's use of the Services.
You must not upload malicious code, scrape or extract any part of the Services, collect other people's personal information, or interfere with or circumvent our security measures. We may suspend or terminate your account without notice if you breach these Terms.
SECTION 14 — AGENTS
14.1 This section applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, and that can be executed on behalf of or using a person's device without direct supervision.
14.2 No Agent may access, use or interact with the Services unless it identifies itself and operates in strict accordance with section 14.4 below. No Agent may access the Services if we have asked it to refrain from doing so.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses and interacts with the Services.
14.4 Agents must: (i) identify themselves in all HTTP/HTTPS requests by including "Agent/[agent name]" in the user agent string; (ii) not conceal or obfuscate that the access is from an Agent, including by mimicking human behaviour or by completing or circumventing CAPTCHAs; (iii) respond truthfully to any question seeking to determine whether interactions are coming from a human or a computer; and (iv) not circumvent any measure intended to block, limit or control how Agents access the Services.
SECTION 15 — TERMINATION
We may terminate this agreement or your access to the Services at any time. You remain liable for all amounts due up to the date of termination. Sections that by their nature should survive termination will continue to apply.
SECTION 16 — DISCLAIMER OF WARRANTIES
Information presented through the Services is provided for general information only. We do not warrant its accuracy, completeness or usefulness, and any reliance you place on it is at your own risk.
Except as expressly stated by KidsStrike, and except where your statutory rights as a consumer apply, the Services are provided "as is" and "as available" without representations, warranties or conditions of any kind. We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.
SECTION 17 — LIABILITY
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under the Consumer Protection Act 1987, or for anything else that cannot lawfully be limited or excluded.
Subject to that, we are not liable for losses that were not foreseeable at the time the contract was made, or for any business loss — including loss of profit, revenue, savings or data.
SECTION 18 — EVENTS OUTSIDE OUR CONTROL
We are not liable for any failure to perform where that failure is caused by events outside our reasonable control. If such an event occurs, we will contact you and either extend delivery times or allow you to cancel for a full refund.
SECTION 19 — SEVERABILITY
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be severed and the remaining provisions will continue in force.
SECTION 20 — ENTIRE AGREEMENT
These Terms and any policies posted by us constitute the entire agreement between you and us and govern your use of the Services, superseding any prior agreements or communications.
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
SECTION 21 — ASSIGNMENT
You may not transfer or assign these Terms or any of your rights or obligations under them without our prior written consent. We may transfer or assign them, provided this does not affect your rights.
SECTION 22 — GOVERNING LAW
These Terms of Service and any dispute arising out of them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
If you are a consumer resident elsewhere in the United Kingdom, you may also bring proceedings in the courts of the part of the UK where you live, and you keep the benefit of any mandatory consumer protections of the law of that country.
SECTION 23 — CHANGES TO THESE TERMS
You can review the current version of these Terms at any time on this page. We may update them by posting changes here, and we will notify you of any material changes as required by law. The version in force when you place an order is the one that applies to that order.
SECTION 24 — COMPLAINTS AND CONTACT
If something has gone wrong, email support@kidsstrike.com and we will do our best to put it right. We aim to acknowledge complaints within 2 working days.
